1. INTRODUCTION

  • Splash Co (Pty) Ltd (“Splash Co”) is committed to safeguarding the privacy and lawful processing of all personal information belonging to Members, parents, guardians, students, employees and visitors.
  • This Privacy Policy explains what data we collect, how we process it, why we process it, and your rights under the Protection of Personal Information Act 4 of 2013 (“POPIA”).
  • By registering with Splash Co or participating in our programmes, you consent to this Privacy Policy.

2. SCOPE OF THIS POLICY

This Policy applies to:

  • (a) All Members and swimmers,
  • (b) All parents/guardians supplying minor information,
  • (c) Website visitors and digital form users,
  • (d) WhatsApp group participants,
  • (e) All persons interacting with Splash Co.

3. DEFINITIONS

  • “Personal Information” includes names, contact details, ID numbers, addresses, medical information, payment details, CCTV and digital data.
  • “Processing” includes collection, storage, updating, use and deletion.
  • “Responsible Party” means Splash Co.

4. PERSONAL INFORMATION COLLECTED

We collect:

  • (a) Identification & Contact Details: name, ID number, address, email, phone number.
  • (b) Minor Details: name, DOB, medical needs.
  • (c) Financial: banking details (secured via Netcash), invoices, payments.
  • (d) Operational: attendance, CCTV recordings, progress notes.
  • (e) Digital: WhatsApp communications, website submissions, marketing engagement.

5. PURPOSE OF PROCESSING

Personal information is processed for:

  • (a) Registration, administration and membership management,
  • (b) Class scheduling, attendance and safety,
  • (c) Medical readiness and emergency response,
  • (d) Debit order processing and billing,
  • (e) CCTV security monitoring,
  • (f) Compliance with legal obligations,
  • (g) Insurance claims,
  • (h) Criminal investigation or fraud prevention,
  • (i) Marketing, promotions and communication — all Members consent to receiving Splash Co marketing material upon registration.

6. CONSENT TO MARKETING

  • By signing up, Members expressly consent to receive:
    • (a) WhatsApp broadcasts,
    • (b) Email updates,
    • (c) SMS messages,
    • (d) Promotions, events and campaign notices.
  • Members may opt out of marketing but may NOT opt out of operational messages (e.g., lightning notices, timetable changes).

7. WHATSAPP GROUPS

  • Members are informed that joining Splash Co WhatsApp groups may reveal their phone number, profile name and profile picture to other Members.
  • Participation is voluntary and at the Member’s sole discretion.
  • Those wishing private communication may request direct broadcast-only updates.
  • Splash Co is not responsible for any misuse of details by other Members.

8. DISCLOSURE OF INFORMATION

  • Splash Co does NOT sell or distribute personal information.
  • Information is only shared:
    • (a) With authorised parties (medical staff, insurers, IT contractors) under confidentiality,
    • (b) When required for law enforcement, fraud prevention, or legal obligations,
    • (c) With Accountability (Pty) Ltd, credit bureaus or attorneys for debt recovery,
    • (d) When required for insurance claims after incidents.
  • Only minimal necessary information is shared.

9. STORAGE, SECURITY & RETENTION

  • Information is stored securely with technical and physical safeguards.
  • Debit order details are stored by Netcash only.
  • CCTV footage is retained for limited periods.
  • Information is kept only as long as legally or operationally necessary.

10. MEMBER RIGHTS UNDER POPIA

Members may request:

  • (a) Access to their information,
  • (b) Correction or updating,
  • (c) Deletion where applicable,
  • (d) Limitation of processing,
  • (e) Withdrawal from marketing lists.

11. CROSS-BORDER TRANSFERS

Splash Co does not transfer data outside South Africa unless:

  • (a) Required by law,
  • (b) Required for insurance,
  • (c) Authorised by the Member,
  • (d) Secure cloud storage is used in compliance with POPIA.

12. CHILD INFORMATION

Information about minor children is collected only with guardian consent and handled with heightened sensitivity, as required by POPIA and the Children’s Act.

13. POLICY UPDATES

Splash Co may amend this Policy with 30 days’ written notice via WhatsApp, email or website.
