Cancellation Policy

1. PURPOSE AND LEGAL STATUS OF THIS POLICY

  • This Cancellation & Termination Policy (“the Policy”) exists to clearly define the rights, obligations, procedures and financial implications applicable when a Member terminates or requests cancellation of their membership with Splash Co (Pty) Ltd (“Splash Co”).
  • This Policy forms an integral part of the Splash Co Terms, Conditions and Indemnity Agreement (“the Agreement”) and is enforceable in the same manner as all other contractual provisions.
  • By registering with Splash Co and by allowing debit orders to run, the Member acknowledges and agrees to be bound by this Policy in full.

2. SCOPE OF APPLICATION

  • This Policy applies to Month-to-Month Memberships, 12-Month Fixed-Term Memberships, all swimmers and participants in all aquatic programmes, and all parents/guardians acting on behalf of minors.

3. FORMAL METHOD OF CANCELLATION

  • All cancellations must be submitted in writing ONLY to info@splashco.co.za.
  • Verbal, WhatsApp, SMS, social media messages or communication to instructors are NOT valid and will not constitute notice.
  • Cancellation becomes effective only once Splash Co has acknowledged the cancellation in writing.

4. CANCELLATION OF MONTH-TO-MONTH MEMBERSHIPS

  • Members must give one full calendar month’s written notice.
  • A full calendar month means notice received on or before the 1st of the month applies to that month; notice after the 1st applies to the next month.
  • Billing continues for the notice month regardless of attendance.

5. NON-CANCELLATION MONTHS: NOVEMBER & DECEMBER

  • No cancellations shall be accepted during November or December.
  • Any cancellation received during these months is only effective from 1 January of the following year.
  • Members remain liable for full December fees, 5-week months enjoyed during the year, and any arrears.

6. CANCELLATION OF 12-MONTH FIXED-TERM MEMBERSHIPS

  • A 12-Month Contract is a full 12-month legal commitment.
  • Early cancellation constitutes repudiation, triggering:
    • (a) Payment of all remaining instalments, AND
    • (b) A Fixed-Term Cancellation Fee based on annual savings.
  • Correct Calculation:
  • Contract fee: R895 × 10 = R8 950 yearly cost.
  • Effective monthly rate: R8 950 ÷ 12 = R745.83.
  • Month-to-Month rate: R1 000.
  • Monthly saving: R1 000 – R745.83 = R254.17.
  • Cancellation Fee = R254.17 × 12 = R3 050.04.
  • Free months are forfeited immediately when cancelling early.

7. TRANSFER AND TIMESLOT LIMITATIONS

  • Memberships and timeslots cannot be sold, transferred or ceded. A new swimmer must register fully.

8. FEES PAYABLE DURING NOTICE PERIODS

  • Billing continues uninterrupted during notice periods.
  • No refunds or credits apply for missed lessons during notice.
  • Debit orders must remain active until the final fee is collected.

9. MISSED DEBIT ORDERS & PENALTY FEES

  • Each missed debit order incurs a R50 penalty fee.
  • Accounts 14 days in arrears may be handed to Accountability (Pty) Ltd.
  • Members will be liable for legal fees, collection costs and possible credit bureau listing.

10. IMPACT ON FREE-MONTH BENEFITS

  • Early cancellation results in forfeiture of free-month benefits which are recovered through the cancellation fee.

11. NO REFUNDS POLICY

  • No refunds apply for illness, injury, relocation, schedule changes, school events, weather delays, or voluntary withdrawal.

12. FINALISATION OF CANCELLATION

  • Cancellation is final only once all fees, penalties, free-month recalculations and arrears are paid, and written confirmation is issued.

13. RE-REGISTRATION AFTER CANCELLATION

  • Rejoining Members are treated as new applicants and must pay registration fees. Previous timeslots are not guaranteed.

14. AMENDMENTS TO THIS POLICY

  • Splash Co may amend this Policy with 30 days’ written notice.

15. ACKNOWLEDGEMENT

  • By participating, the Member acknowledges understanding and acceptance of this Policy in full.
